Further to our conversation, we are glad to have had
the opportunity of discussing the possible sale of
the above property with you and very much hope to
receive the favour of your instructions to offer the
property for sale by Private Treaty.
Prior to receipt of such instructions, we are required
by Section 18 of the Estate Agents Act 1979 as amended
by the Estate Agents (Provision of Information) Regulations
1991, to set out our terms of business which are as
follows:
- In the event of APS Estates introducing, communicating
or arranging a sale (whether directly or indirectly)
to any purchaser(s), a commission will become due
upon exchange of contracts, payable from the proceeds
of sale by your Solicitor/Conveyancer with your authority.
- Should you decide to instruct us on a multiple-agency
basis, i.e. in competition with other directly instructed
agents, our commission will amount to 3% + VAT of
the eventual sale price.
- Should you decide to instruct us on a sole-agency
basis, our commission will amount to 2% + VAT of the
eventual sale price.
Sole Agency
You will be liable to pay remuneration to us, in addition
to paying other costs or charges agreed, if at any
time unconditional contracts for the property are
exchanged
- with a purchaser introduced by us during the period
of our sole agency or with whom we had negotiations
about the property during that period, or
- with a purchaser introduced by another agent during
that period.
Our commission charge is inclusive of fees and expenses.
We also offer a comprehensive range of professional
services which are available to both yourselves and
any prospective purchasers other than where a conflict
of interest arises.
